The Higher People's Court of Jiangsu Province issued the "Announcement on the Performance of Duties of the Nanjing Maritime Court", confirming that the Nanjing Maritime Court will perform its statutory duties on December 4, 2019.
It is reported that the Nanjing Maritime Court has jurisdiction over the extension of the sea from the junction of Jiangsu Province and Shandong Province to the junction of Jiangsu Province and Shanghai, the main and branch waters of the Yangtze River from the junction of Jiangsu Province and Anhui Province to the mouth of the Liuhe River in Jiangsu Province, and Jiangsu Province Cases involving ports and navigable waters within the administrative area. In accordance with the Supreme People’s Court on the Scope of Acceptance of Cases by the Maritime Court, the Nanjing Maritime Court will accept maritime tort disputes, maritime contract disputes, maritime and navigable waters development and utilization and environmental protection related disputes, and other maritime maritime disputes. Cases of first instance in 108 types of six categories including commercial dispute cases, maritime administrative cases, and maritime special procedures cases. If the party is dissatisfied with the judgment or ruling made by the Nanjing Maritime Court and appeals, it shall be heard by the Jiangsu Higher People's Court.
After December 4, 2019, Wuhan Maritime Court and Shanghai Maritime Court will no longer accept cases within the jurisdiction of Nanjing Maritime Court; cases that have been accepted before this will no longer be transferred, and their appeals will still be handled by the Hubei Provincial Higher People’s Court and Shanghai respectively.
